COURT TEMPORARILY WITHDRAWS TAMBUA’S CASE

THE allegations of sexual offences against the Member for Goroka, Hon. Aiye Tambua, have been temporarily withdrawn and referred back to the office of the Police Commissioner.

This decision was made by Waigani Committal Court Magistrate Paul Puri Nii during a ruling this morning.

Magistrate Nii found the evidence presented by three police investigators were divided.

He expressed concern over handling cases with divided interests within the police force, deeming it unhealthy for the court.

An affidavit was submitted to the court on July 8, 2024, by First Constable Adrianna Kamasuga. The affidavit disputed evidence held by prosecutor Christian Iga, which has yet to be presented in court.

Kamasuga indicated that her division was unaware of the material and evidence in prosecutor Iga’s possession.

Magistrate Nii emphasized the need for a thorough investigation by the police department before the case can proceed.

 “For the interest of justice and fairness, I will make an order that will be just in the circumstance. The victim needs justice, and so does the defendant. A proper investigation based on merit is required for the case.”

Magistrate Nii declared that he would not accept evidence from police personnel with divided interests.

He referred the matter back to the Police Commissioner for a proper investigation to be conducted when the police are ready to progress with the allegations.

The court ordered that Tambua be discharged from all bail conditions and that his bail money be refunded.
