THE Supreme Court dismissed the proceedings of the Supreme Court Special Reference application filed by Opposition Leader Hon. Douglas Tomuriesa on competency grounds this afternoon.
The five-man bench upheld two of the seven objections to competency filed by the Attorney-General Hon Pila Niningi.
The Supreme Court ruled that they had no authority to rule on this matter in a constitutional sense as required by the Court.
The Court stated that while they had refused five of the grounds of objection to competency, they upheld two of the objections.
Chief Justice Sir Gibbs Salika, when reading his judgment, said the Court has no jurisdiction to entertain the application.
“The objection to competency of the proceedings is upheld and proceedings are entirely dismissed,” the Chief Justice said.
