THE suspended Managing Director of the National Airport Corporation (NAC), Rex Kiponge, has received legal advice to prevent his termination while his court case against the NAC is still ongoing.
Isaac David, a lawyer from Kalit Legal Consulting Firm, advised Ian Mileng, the acting Company Secretary of NAC, not to terminate Mr Kiponge.
In a letter dated 28/04/23, Mr David wrote that: “The Court Deputy Chief Justice Ambeng Kandakasi, upon consent of parties, made orders yesterday (27/05/23) restraining NAC and Board of Directors of NAC from terminating Rex Kiponge’s term as the Managing Director of NAC until the substantive matter is dealt with. You were there, and you were well aware of the court order of 27/04/23. We will take out the formal orders and serve on you shortly.”
Mr David further advised that “in respect of the court order of 27/04/23, we advise that NAC is restrained from implementing any decision made by the National Executive Council in terminating Mr Rex Kiponge until the substantive matter is dealt with. We, therefore, ask you to advise the NAC and its Board of Directors accordingly.”
