In the matter OS. NO. 303 OF 2023 between Tomait Kapili vs Electrol Commisioner Mr Simon Sinai and State at Mt. Hagen National Court regarding the decision by Electrol Commisioner to change counting venue for Lagaip Supplementary election to Goroka from Wabag.
The matter went before Toliken J this afternoon at 1:30pm for inter-parte Hearing. Mr Donald Kints of Jema Lawyers appeared for the Electrol Commission whereas Mr Epeo Minok for Tomait Kapili as the Plaintiff.
Legal counsels had a good argument but after all, the Court raised the issue of urgency of the matter as the Writ of Return is due next week.
The Court then directed the parties to find an amicable solution for the counting venue to be chosen before 9am tomorrow morning.
The Court directed and ordered Mr Donald Kints (legal counsel) to talk to Electrol Commisioner Mr Simon Sinai before 9am tomorrow (Friday). The matter returns to Court Friday morning at 9am.
Lawyer Mr. Epeo Minok for the Plaintiff (Tomait Kapili) had also talked to Mr Kints to advise his client (Electrola Commision, and Commisioner Mr Simon Sinai) to reconsider his decision and counting musta progress in Wabag without further delay.
The Enga PPC George Kakas who was also in the Court house advised Electrol Commision through its lawyer as to inform Mr. Simon Sinai to reconsider his decision and call for counting in Wabag. PPC Kakas told Mr. Kints that police and denfence (security personnels) are ever ready to provide security in Wabag for counting. Case returns to Court tomorrow (Friday) morning at 9am with an amicable solution for the counting agreed by parties as per courts directive today.
